Cabinet approves National Identification Authority Bill!

The Union Cabinet today approved the proposal for introducing the National Identification Authority of India Bill, 2010 in Parliament.The UID project is primarily aimed at ensuing inclusive growth by providing a form of identity to those who do not have any identity.
It seeks to provide aadhaar numbers to the marginalised sections of society and thus would strengthen equity. Apart from providing identity, the aadhaar number will enable better delivery of services and effective governance.

The Bill seeks to establish the National Identification Authority of India for the purpose of issuing aadhaar numbers to individuals residing in India and to certain other classes of individuals, the manner of authentication of such individuals and other related and incidental matters.

The Bill proposes to constitute a statutory authority to be called the National Identification Authority of India and lay down the powers and functions of the authority, the framework for issuing UID numbers (aadhaar numbers), major penalties and other related matters through an Act of Parliament.

The government will decide on the price band for Coal India's up to $3 billion initial public offering by the second week of October, a senior official at the state-run firm said on Friday.

Earlier this week the share sale, expected to be the biggest by an Indian firm, received a go-ahead from the markets regulator, sources said.

A decision on issuing shares to anchor investors will be taken "before that", N.C. Jha, Director (Technical) at Coal India, told reporters on the sidelines of a conference.

The Coal India IPO will open on Oct. 18 and close on Oct. 21.

With a speeding goods train killing seven elephants in West Bengal's Jalpaiguri district, the matter has been taken up with environment and forest ministry and efforts on to meet railway minister Mamata Banerjee.

"We have taken up the matter with the Union ministry of environment and forest and a high-level meeting has been scheduled next week to discuss ways to prevent such accidents," Chief wildlife warden West Bengal S B Mondol said.

Subsequently, a meeting with Railway Board officials and the forest department will be held in New Delhi on September 28, he said.

Chief conservator of forest (Wildlife), North Bengal S Patel said he would submit a report on the accident.

Describing the death of seven elephants yesterday as "unprecedented and shocking", WWF (WB) Director Sashwati Sen said they were trying to meet railway minister Mamata Banerjee.

"Unless the matter is taken up at the top level, no positive step will be taken to prevent such accidents. Our earlier appeals have fallen on deaf ears," she said.

Sen said the WWF had earlier asked for halting movement of night trains in the New Jalpaiguri-Alipurduar section passing through wildlife sanctuaries and National Parks and restricting their speed.

Principal chief conservator of forests Atanu Raha said accidents involving elephants had increased after conversion of tracks from meter gauge to broad gauge.

He said elephants being intelligent knew about timings of couple of trains that passed when the tracks were metre gauge.

After the tracks were converted to broad gauge and goods train began running at all times of the day it confused the pachyderms, he said.

Col S Banerjee, currently director, WPSI, Eastern region, who had filed a PIL in 2001 opposing the gauge conversion, said his apprehensions were now coming true.

He said all wildlife NGOs should jointly pressurise the government to adopt measures to save elephants and other animals from trains.

With various measures were being suggested by the forest department and NGOs, field director of Buxa Tiger Reserve R P Saini said the only alternative to prevent such accidents was to construct elevated tracks in that area.

However, secretary of Nature Environment and Wildlife Society Biswajit Roy Chowdhury, expressed doubt whether the railways would agree to construct elevated tracks for such a long distance as it would be a costly affair.

He said construction of a separate railway line might be of some help.

The project will involve an expenditure of Rs 3023.1 crore which includes project components for issue of UID numbers (called aadhaar numbers) by March 2011, and recurring establishment costs for the entire project phase of five years ending March 2014, a statement said.

At a time when the country is facing several internal security threats, home-grown security solutions firm Orkash has developed an automated intelligence- based network to combat situations such as terrorism, Naxalism and insurgency.

"Our first-of-its-kind Unconventional Conflict and Intelligence Management System (UCIMS) helps in analysing terrain and the civil demographic areas to give intelligence insights to armed forces/para-military forces for taking preemptive measures to avert situations like a terror attack," Orkash Founder and CEO Ashish Sonal said.

The system named Unconventional Conflict and Intelligence Management System (UCIMS) is highly capable of collaborating various databases and information sources to create local intelligence pivotal to executing sharp, focused operations.

This advanced battlefield management system answers the need for operational planning, monitoring, intelligence management and decision-support control system to help the security forces engage with a more advanced and effective tactical response to unconventional conflicts.

Moreover, it also helps in collaborating location-based intelligence and operations planning to facilitate multi- agency tactical operations in the midst of civilian population, the company said.

Orkash, a Gurgoan-based management consulting and hi- technology services firm provides risk management, market intelligence and business assurance services for emerging markets.

Chairman of Unique Identification Authority of India (UIDAI) Nandan Nilekani today said the Unique Identification Number, renamed as 'Aadhaar', would be issued in a few days to Indian residents.

"We will issue the UID numbers in a few days," Nilekani told reporters on the sidelines of AIMA convention in Kolkata.

He said in the first four years, 600 million people would be covered and the UID number would be useful for a number of applications like financial inclusion.

The UIDAI had discussed with RBI for preparing the roadmap for financial inclusion with help of micro-ATMs, he said.

A unique eco-system would be created, he said, where the authority would be surrounded by registrars which would be either banks, oil companies or public sector units.

Nilekani said a big challenge which UID was facing was of de-duplication. Giving UID number was akin to giving mobile identity to a person using biometric technology.

He said approaching the authority for a second time would be made a penal offence.

Nilekani said the online verification of the UID number would be done in five to six seconds and would also work on the mobile network.

To a query, he said implementation of the project would also require stable internal security.

         What is Aadhaar?

Aadhaar is a 12-digit unique number which the Unique Identification Authority of India (UIDAI) will issue for all residents. The number will be stored in a centralised database and linked to the basic demographics and biometric information – photograph, ten fingerprints and iris – of each individual. The details of the data fields and verification procedures are available here.


Aadhaar will be:

Easily verifiable in an online, cost-effective way

Unique and robust enough to eliminate the large number of duplicate and fake identities in government and private databases

A random number generated, devoid of any classification based on caste, creed, religion and geography

    Why Aadhaar?

Aadhaar-based identification will have two unique features:

Universality, which is ensured because Aadhaar will over time be recognised and accepted across the country and across all service providers.

Every resident's entitlement to the number.

The number will consequently form the basic, universal identity infrastructure over which Registrars and Agencies across the country can build their identity-based applications.

Unique Identification of India (UIDAI) will build partnerships with various Registrars across the country to enrol residents for the number. Such Registrars may include state governments, state Public Sector Units (PSUs), banks, telecom companies, etc. These Registrars may in turn partner with enrolling agencies to enrol residents into Aadhaar.

Aadhaar will ensure increased trust between public and private agencies and residents. Once residents enrol for Aadhaar, service providers will no longer face the problem of performing repeated Know Your Customer (KYC) checks before providing services. They would no longer have to deny services to residents without identification documents. Residents would also be spared the trouble of repeatedly proving identity through documents each time they wish to access services such as obtaining a bank account, passport, or driving license etc.

By providing a clear proof of identity, Aadhaar will empower poor and underprivileged residents in accessing services such as the formal banking system and give them the opportunity to easily avail various other services provided by the Government and the private sector. The centralised technology infrastructure of the UIDAI will enable 'anytime, anywhere, anyhow' authentication. Aadhaar will thus give migrants mobility of identity. Aadhaar authentication can be done both offline and online, online authentication through a cell phone or land line connection will allow residents to verify their identity remotely. Remotely, online Aadhaar-linked identity verification will give poor and rural residents the same flexibility that urban non-poor residents presently have in verifying their identity and accessing services such as banking and retail. Aadhaar will also demand proper verification prior to enrolment, while ensuring inclusion. Existing identity databases in India are fraught with problems of fraud and duplicate or ghost beneficiaries. To prevent these problems from seeping into the Aadhaar database, the UIDAI plans to enrol residents into its database with proper verification of their demographic and biometric information. This will ensure that the data collected is clean from the beginning of the program. However, much of the poor and under-privileged population lack identity documents and Aadhaar may be the first form of identification they will have access to. The UIDAI will ensure that its Know Your Resident (KYR) standards do not become a barrier for enrolling the poor and has accordingly developed an Introducer system for residents who lack documentation. Through this system, authorised individuals ('Introducers') who already have an Aadhaar, can introduce residents who don't have any identification documents, enabling them to receive their Aadhaar.

How to get an Aadhaar?
The process to get an Aadhaar will be circulated by the local media upon which residents need to go to the nearest Enrolment Camp to register for an Aadhaar. The resident primarily needs to carry certain documents which will be specified in the media advertisement.
Upon registering for Aadhaar, residents will go through a biometric scanning of ten fingerprints and iris. They will then be photographed and given an enrolment number upon completion. Depending on the enrolment agency, residents will be issued an Aadhaar number within 20 to 30 days.

Contact Centre Details

The UIDAI will set up a Contact Centre to manage all queries and grievances and serve as a single point of contact for the organization. The details of the Contact Centre will be published on the website as and when enrolment begins.

The users of this system are expected to be residents, registrars and enrolment agencies.

Any resident seeking enrolment is given a printed acknowledgement form with an Enrolment Number, that enables the resident to make queries about her/his enrolment status through any communication channel of the contact centre.

Each enrolment agency will be given a unique code that will also enable faster and pointed access to the Contact Centre that includes a technical helpdesk.

Obama looking forward to India trip; Michelle excited

US President Barack Obama is looking forward to visiting India in early November and first lady Michelle is excited about the trip.

Obamas conveyed this to Indian External Affairs Minister SM Krishna at a reception they hosted at the Natural History Museum here in honour of heads of delegation attending the United Nations General Assembly.

Obama told Krishna that he was looking forward to visiting India and Mrs Obama added that she was excited about the trip, diplomats said.

Earlier, in his speech to the UN general assembly too he made a reference to his upcoming trip to India.

"Later this fall, I will travel to Asia. I will visit India, which peacefully threw off colonialism and established a thriving democracy of over a billion people," Obama told the annual gathering of world leaders in his second address to the world body since becoming president.

High stakes for US in Indian economy: Sharma

WASHINGTON: In a clear signal that its growing economy has high stakes for the American business, from nuclear to space sciences, India has asked the US to refrain from "irritants" like protectionist campaign against offshore outsourcing.

"These are avoidable irritants, like what the Ohio outsourcing ban has been and hopefully that will not happen," Indian Commerce and Industry Minister Anand Sharma said here yesterday at an interaction with the Council on Foreign Relations, a prestigious think tank.

As the two countries are fast paving way for nuclear commerce, several US companies engaged in the atomic reactors are eyeing the lucrative and large Indian energy market. India is aiming at generation of 20,000 MW nuclear power by 2020 from 4,000 MW at present.

Sharma said two countries are engaged in a strategic partnership and, "we should do only what helps in strengthening and consolidating this partnership, because there is so much at stake here, from agriculture to nuclear and space sciences, when we are engaged".

Hoping that the recent developments on visa fee hike and ban on government outsourcing by the Ohio state would only be "transient", he said they should get resolved for the sake of larger picture of bilateral engagement.

"These developments sometimes end up creating transient negativity. It will hopefully get appropriately addressed when the larger picture is viewed...We must not lose sight of the long-term objectives," he said.

India and the US had a bilateral trade of about USD 36 billion in 2009-10. Besides growing demand from 8.5-8.8 per cent economic expansion, India offers a large scope for the US defence manufacturers.

Reports suggest that the two countries are negotiating a close to USD six billion defence deal for aircraft purchase from Boeing.

After the bilateral Trade Policy Forum (TPF) meeting here on September 21, Sharma had said that largest orders for Boeing aircraft have also been placed by India. "How many (US) jobs would have been sustained and and how many jobs would be created?," he had asked.

A burden of their professional obligations, legal practitioners have to acquire the acumen to walk up and down on both sides of the street, though not necessarily at the same time. The recent tiff between the Supreme Court and the government over the respective jurisdictions of the judiciary and the executive has provided an occasion for the display of two sets of legal argument directly opposed to each other. Both views appear to be equally weighty.

One group of lawyers have little doubt that the directive of the nation's highest judiciary directing the authorities to distribute free foodgrains to the poor and the starving was, howsoever well-intentioned, a gross encroachment on the government's ambit of responsibilities as laid down in the Constitution. What policies and measures are to be adopted to provide food security to the nation are matters within the purview of administrative decision-making; these should be left to the exclusive care of the government, which represents the will of the people; the judiciary must not poach in the matter, it must rein in its 'activist' propensities.

The other group of lawyers are strongly supportive of the Supreme Court's observations. They fall back on certain provisions in the Constitution. True, the Constitution does not quite list among the fundamental rights of citizens the right to food; Article 21, however, concedes them the right to life. Since food is essential for living, and the judiciary has the prerogative to ensure that a citizen is not deprived of any of his fundamental rights, the Supreme Court, it is argued, is within its rights to ask the government to supply food, free of cost, to starving people who do not have the resources to buy food from the market.

One of the directive principles of State policy embedded in the Constitution is also referred to in this connection. That particular directive expects the State to assure citizens the means of livelihood. Whether food, which is the most essential means for staying alive, is being reached to the starving, it can well be interpreted, is something which should very much be the concern of the judiciary; it is within its ambit of responsibilities to instruct the State to act in conformity with the directive principle.

Should both the judiciary and the executive stick to their respective positions, the debate could be interminable. As far as the ground reality goes, the government, in any event, is bound to win out. If it chooses to ignore the directive of the Supreme Court — it has already expressed such an intention — the nation's highest judiciary has no instrument at its disposal to discipline the authorities. It could, at best, declare the government to be guilty of contempt of court. So what? There is no way it could punish the government for the committed offence. A situation is conceivable where, snubbed in this manner, the judges constituting the Supreme Court resign en masse and create a national crisis. That is, however, a most remote possibility.

There are, though, more things in the actual world than observance or non-observance of constitutional propriety. In the instance being referred to, it has suited the government to conceal some issues of grave import behind the smokescreen of the controversy over respective jurisdictions of the executive and the judiciary. What are being slurred over are the moral and humanitarian aspects of a circumstance in which, at one end, huge numbers of the country's poor are starving and, at the other, substantial quantities of foodgrains available with the government are rapidly going to waste because these are lying in the open on account of a lack of warehousing facilities. The Food Corporation of India, an arm of the government, procures foodgrains, mostly wheat and rice, from farmers and traders by paying prices that are higher than the prevailing market prices. Foodgrains thus procured are distributed to consumers through the public distribution system.

The FCI is, at the moment, carrying a total stock of grains exceeding 50 million tonnes, but storage space available to it can only accommodate 45 million tonnes. New warehouses are coming up and much scrounging is going on to rent extra space. Even so, the corporation has been compelled to keep a part of the procured grains in open space, exposed to the elements. A not-so-negligible amount of these grains lying under the naked sky is, on the government's own admission, rotting at a very fast pace and will soon be unsuitable not only for human, but also for animal, consumption. Against this background, responding to a public interest litigation filed before it praying for supply of foodgrains to starving sections of the population, the Supreme Court thought it fit to ask the government to allot for free distribution to poor people some of the grains that are about to be totally spoiled.

Let us assume that the quantum of grains dumped outside the godown and getting rotten is one million tonnes. The overall cost of procuring this quantity might be around Rs 1,000 crore. The government's point of view can be summed up as follows: even if the grains go to total waste and Rs 1,000 crore of public money go down the drain, these grains could still not be supplied free of cost to any citizens, not even to the starving, the authorities have no alternative but to be stern and brush aside so-called humanistic considerations. They have based their decision, it is claimed, on solid economic grounds. Even grains soon bound to be totally wasted could not be supplied free to the poor, at zero price, for that would be horrendously bad economics. It would affect adversely the incentive for grain production and have a negative impact on its output in future, causing great harm to long-range national interests.

The argument is based on the orthodoxy of what is known as neoclassical economics, which says that there must be no intervention from outside with the interplay of the forces of supply and demand in the market. If a government agency supplies free a certain quantity of foodgrains to a section of consumers, it will supposedly affect the demand side of the market and depress the market price, thus discouraging the producers. This point of view is regarded as holiest of the holy — the government would rather allow Rs 1,000 crore worth of foodgrains to go waste than utilize these to feed the hungry.

The nation's long-term interests, the argument runs, lie in a healthy rate of growth in agriculture, including foodgrain production; anything that could harm these interests must be abjured. The dictum to be followed is that there can be no free lunch, not even for the starving. The crucial importance of not deviating from this cardinal principle has been impressed upon the government by sponsors of the so-called Washington Consensus, whose writ is assumed to be as inviolable as the Ten Commandments.

The authorities will not walk the morality ground — heartlessness is king. But it is not really necessary to bring in issues of either ethics or humanitarianism in the matter. The government can be rebutted even on its own chosen ground. Has not the FCI already bought that lot of one million tonnes of grains from farmers and traders by paying procurement prices that are, in fact, higher than the prices prevailing in the market? How, then, could there be any possibility of discouraging producers? Farmers have already sold the grains at prices that have satisfied them; whether the grains are fed to rats or dumped in the Arabian Sea or used to feed some hungry people would be of no concern to them.

As long as the FCI continues to purchase at prices that are higher than going market prices, producers' incentive will remain unaffected in future too. That apart, poor starving people have no purchasing power, they have therefore no role to play on the demand side of the market. That is to say, given their zero purchasing power, they are irrelevant for the market process. Irrespective of whether the poor and starving are supplied free grains or allowed to perish without food, they are, in either case, not going to participate in the market process. The economic reasoning that the authorities have advanced for ignoring the Supreme Court's advice is, in sum, without basis. Not to mince words, it is comprehensibly bogus. It is a government's prerogative to be inhuman. In a functioning democracy, the electorate can be exploited to deal with such an administration in due course. The deployment of spurious economic logic to cloak that inhumanity nonetheless deserves to be exposed.

UID to enroll 600 mn members in 4 years: Nandan Nilekani
KOLKATA: The government's ambitious unique ID project will start rolling out the UID numbers over the next few days and will enroll 600 million members in the first three to four years, Nandan Nilekani, the chairperson of the UID Authority of India (UIDAI), said in Kolkata on Wednesday.

Mr Nilekani once again clarified that UID will not be a proof of citizenship but will be an online authentication system to verify a person's identity. UIDAI has registered 220-odd enrolment agencies who will collect data on behalf of the registrars.

The authority has made sure that all entities collecting data follows the same quality standards for which hardware and software specifications have been laid down. The entire system will have the capability to process a million data each day.

"We are developing a system that will also enable verification over mobile network and use simple devices like mobile phones attached with biometric equipment. UID will comprise of name, date of birth, sex and father's name along with fingerprints as well as both the irises. The online verification system will just take about 7-8 seconds to authenticate and the answer will come in the form of a simple 'yes or no'," he said.

"Once the enrolment process is started and numbers are assigned to individuals various services and applications based on the UID system will be developed. These applications can offer various services to masses at large. It will essentially help in offering better delivery services by the government in sectors like public distribution system, healthcare and disbursement of pension as well as banking facilities," he added.

Interestingly, Mr Nilekani informed that the RBI is in the process of rolling out a road map for financial inclusion along with banks and institutions can develop applications based on the UID systems. Nevertheless, including people outside the system, with no proof of identity, is a challenge. Therefore UIDAI has devised a system where a non-government organisation (NGO) or an introducer can stand guarantee for such persons.

BSE Sensex set for fourth straight weekly gain

MUMBAI (Reuters) – The BSE Sensex (^BSESN : 20045.18 +184.17
Cigarette-to-hotel business ITC and India's largest household products maker Hindustan Unilever led the gains, riding on the strong domestic consumption story.
ITC rose as much as 2.3 percent to its all-time high of 180.70 rupees while Hindustan Unilever surged 4.8 percent to 317.25 rupees, its highest in a decade.
At 11:33 a.m. (0603 GMT), the 30-share BSE Sensex was up 0.28 percent at 19,916.65 points, with 18 of its components advancing. It has gained 1.7 percent so far this week.
"It does not look like huge upside left for the market in the near term. That said, there are no big immediate risks to pull the market down either," said Neeraj Dewan, director of Quantum Securities.
Dewan said a consolidation was likely and he expected Sensex to move in a 19,500-20,500 points band in the near term and that the next trigger in sight was September-quarter earnings.
Foreign funds have pumped in $17.3 billion in Indian equities so far in 2010, driving the main stock index 14.1 percent higher from a year earlier. This follows net inflows of $17.5 billion in 2009, which had led to an 81-percent rally in the benchmark.

Outsourcer Mahindra Satyam (SATYAM.BO : 100.1 -6.4
"Optimism in Satyam's growth prospects is being driven by overall buoyancy in demand seen in the Indian IT sector," CLSA said in a note on Thursday.
"However, we do not expect Satyam's growth to follow the sector prospects in FY11 or even in FY12."
In the broader market, advancers were more than double the number of decliners in a volume of 210 million shares.

India a 'must-invest market': Nooyi

Pepsi Co Chief Indra Nooyi described India's infrastructure appalling with projects here showing too much slippage in their execution, but emphasised that the country is a 'must invest market'.
"If I used the word appalling that would be bit of an understatement," Nooyi said during the panel-discussion in New York organised by the Indian American Foundation and Yale University.
She said although there has been some development in infrastructure but the couple of highways and airport were not enough.
"I'm not saying developments have not been made but its not as fast as it needs to be...Unfortunately every project that starts, there is too much of slippage."
The Indian-born businesswomen stressed on the need for India to do a lot more to strengthen its basic infrastructure, for companies wanting to invest in India. "The first biggest issue we have is infrastructure."
Nooyi underlined that reaching every nook and corner of India require roads, electricity, power and water. "Even if they have an MBA or an engineering degree unless they came from a top tier of schools they are not as qualified as they need to be...We always have to retrain them inside the industry," Nooyi said.
"I think we have to take this manpower, which is very bright but we have to make sure we educate them the right way," she continued.
Fareed Zakaria, an international relations expert and journalist, pointed out that one of the reasons for the government's complacency could be the fact that India's economic growth had come to easily.
"The East-Asian crisis was the moment, when all those East-Asian countries did massive reforms and in India you're getting 7 to 8 per cent growth without doing very much reforms has stalled in India," Zakaria said.
Rakesh Mohan, leading Indian economist who was also on the panel, countered this assertion by noting that any given time the argument of "not much is happening right now."
"You can't have bursts of reform every year. So it has to be now much more incremental reform in every area," he said.
Mohan, however, admitted that India had probably gone ahead with the easier reforms or "reforms by announcement" like de-licensing and removing trade barriers earlier, and was now stuck with the tougher ones.
"Now we have all are process reforms, which can't be done by announcement," he said.
Noting that India was aware of its problem, Nooyi added that the say:do ratio is a little bit out of whack.

Warren Buffett: 'We're still in a recession'

NEW YORK (Reuters) - Billionaire investor Warren Buffett said the U.S. economy remains in recession, disputing this week's assessment by a leading arbiter of economic activity that the downturn ended more than a year ago.
"We're still in a recession," Buffett told CNBC television in an interview broadcast on Thursday. "We're not gonna be out of it for a while, but we will get out."
On Monday, the National Bureau of Economic Research said the world's largest economy ended an 18-month recession in June 2009, but cautioned that its assessment did not mean normal activity had resumed.
Buffett said he defines a recession differently from the NBER, saying it ends when real per capita gross domestic product returns to its pre-downturn level.
President Barack Obama said on Monday that economic weakness is "still very real" for the millions of Americans who are out of work, have seen the value of their homes fall, or are mired in debt.
Buffett, 80, runs Berkshire Hathaway Inc, which has roughly 80 operating businesses. "A great majority" of these businesses are "coming back slowly," he said.
Berkshire's operations cover a broad swath of the economy, including the Burlington Northern Santa Fe railroad, Dairy Queen ice cream, Geico auto insurance, and luxury jewelers such as Borsheim's.
Shipments at Burlington Northern are "61 percent of the way back," Buffett said. "Our carpet business, our brick business, our insulation business, they're not back 61 percent, but they are moving back."
On Tuesday, the U.S. Federal Reserve, which has already driven short-term lending rates to near zero, said it is prepared to provide additional stimulus to support economic expansion and avert possible deflation.
"We've used up a lot of bullets," Buffett said. "And we talk about stimulus. But the truth is, we're running a federal deficit that's 9 percent of GDP. That is stimulative as all get out."
Buffett's $45 billion net worth makes him the second-richest American, trailing only Microsoft Corp co-founder Bill Gates, Forbes magazine said on Wednesday.
Berkshire Class A shares fell 0.6 percent to $123,077 in morning trading. They traded as high as $126,160, their highest level in nearly 23 months, on Sept. 17.

Aamir Khan''s "Peepli Live", depicting the growing rural-urban divide in India, has been selected as India''s official entry to next year''s Oscars in the Best Foreign Film category. "''Peepli Live'' has been selected as India''s official entry for the Oscars out of 27 films," Supran Sen, secretary general of the Film Federation of India, told PTI. Directed by debutant Anusha Rizvi, the film stars theatre actors and was shot in a small village in Madhya Pradesh.
The film also takes pot shots at the media and the political system in the country. This is third time lucky for Aamir Khan Production as the actor''s previous films "Lagaan" (2001) and "Taare Zameen Par" (2007) were also selected to represent India at the Academy awards.

CoalMin seeks equality for PSUs, pvt coal cos in profit sharing

Coal Minister Sriprakash Jaiswal said there was no proposal for granting concessions to PSUs in the 26 per cent profit sharing scheme, envisaged in the new mining bill being framed, and favoured a level playing field in the sector.

"Definitely, it should be there," Jaiswal said when asked whether there should be a level playing field for the PSUs and the private players in the profit sharing regime.

He added that there is no proposal (before the Group of Ministers) to give concessions to the PSUs.

Jaiswal's view is in contrast to the Steel Minister Virbhadra Singh's demand to give "special consideration" for PSUs like SAIL and NMDC in the proposed profit sharing regime.

Supporting Jaiswal's view, Coal India Ltd (CIL) Chairman Partha S Bhattacharyya said his company has been undertaking CSR activities for long and supported the proposed policy initiative for "distributive justice" to the local people displaced or affected by mining projects.

"We are not seeking any concession in profit sharing," Bhattacharyya said.

Another PSU SAIL, along with private steel maker Tata Steel, has questioned the modalities of such a pay-out.

"We are aware of the government's objective of benefiting the displaced. In that framework, we are discussing various issues -- is the levy too high, how will it be implemented, modalities of the payment, whether such practices are going on in other countries like Australia, Brazil, etc," SAIL Chairman C S Verma said.

Tatas have also criticised the proposal and asked the government not to charge 'profit-sharing' as a separate tax, saying that social obligation is part of the operating cost of the company.

Besides, the proposal has been termed 'discriminatory' by Jindal Steel and Power, which is led by industrialist-turned politician Naveen Jindal. The firm has termed the proposed 26 per profit sharing as too high.

Last week, a 10-member ministerial panel headed by Finance Minister Pranab Mukherjee arrived at a consensus on the new Mining Bill, which, among other things, makes it mandatory for firms to share 26 per cent of the profit from mining with project-affected people. The panel is to meet soon to clear the final draft of the Bill.

Meanwhile, on the upcoming initial public offer of CIL, Bhattacharyya said a group of ministers will take a decision by the end of this month on whether to rope in anchor investors for the IPO, which is likely to generate up to Rs 15,000 crore.

He said the company will be import four million tonnes of coal for NTPC and two million tonnes for Damodar Valley Corporation in next 45 days.

Prithvi-II fails to take off in user's trial
BALASORE: India's indigenously developed nuclear capable Prithvi-II ballistic missile failed to take off during a user trial from the Integrated Test Range at Chandipur off the Orissa coast on Friday apparently due to a technical problem, defence sources said.

Though the ITR authorities were not immediately available for comment, defence sources said the sophisticated missile could not take off during the planned trial from the launch complex-III of the test range due to some "technical snag."

"The failure to lift Prithvi-II was due to a snag either in the main missile or the sub-system, including the launcher," they said, adding the test-fire was slated to be held as part of user's trial by the armed forces.

During Friday's planned trial, a noise could be heard as smoke billowed from the launch site around the time of the blasting.

Efforts were on to ascertain the exact reason behind the failure on the part of the missile to take off and defence scientists were examining the matter thoroughly, they said.

The last four user's trials of the surface-to-surface missile were successfully conducted during the about one year period, from the same site in the ITR.

The last trial was conducted on June 18, this year. The test firing of the state-of-the-art missile, which has already been inducted into armed forces, was planned as users trial by the specially formed "Strategic Force Command" (SFC), the sources said.

Stopping mining projects not a solution to displaced people: FM
Amid tribals protesting against some mining projects, the Government on Friday said that people being displaced should be provided alternative sources of livelihood, besides adequate compensation, but solution does not lie in stopping projects.

"Answer does not lie in the companies stopping mining activities. Answer lies in providing alternatives to those displaced... in what form we can compensate them and make them beneficiary of economic development," Finance Minister Pranab Mukherjee told the Coal Summit.

Mukherjee's comments come at a time when a Group of Ministers (GoM), headed by him, is deliberating upon a proposal to give tribals a part of profits in mining projects.

"We are addressing this issue," he said. The GoM has proposed that 26 per cent of the net profit of mining projects should go to the displaced tribals and other affected locals.

However, the proposal has been criticised in certain quarters.

Meanwhile, the Mines Ministry had said its final draft will go with the recommendations of the GoM.

"Based on the discussion of the Group of Ministers, the final draft of the new mining bill is being prepared by the Mines Ministry and will be placed before the GoM. After that it is to be sent to the Cabinet," Mines Secretary S Vijay Kumar had said.

The GoM will meet soon to clear the final draft of the Bill.

An estimated Rs 1.5 lakh crore worth of greenfield steel projects of ArcelorMittal and Posco have been delayed for about 5 years due to tribal protects against land acquisition in areas like Orissa and Jharkhand.

Mukherjee also asked coal companies to make investment in coal washing to realise better returns in the long run.

"In our medium term plan we should emphasise on coal washing. The moment we supply washed coal to the end users, I think we can charge little more... therefore more investment in this aspect will be paying in the long term," he said.

Maoists against hydropower projects under foreign investment
KATHMANDU: Nepal's Maoists have voiced their opposition to hydropower projects being developed in the country through foreign investment, including from India.

Unified CPN-Maoist's Standing Committee member and Energy Department chief Lila Mani Pokharel said the party would protest against any hydropower project that would be developed through foreign investment.

The Maoists have decided to oppose those projects which they thought would be against national interest, he told reporters here.

In a separate statement, Maoists demanded review of terms and conditions of water resources project that have not gone through parliamentary endorsement as per the interim Constitution.

Contracts and agreements reached with foreign multinationals -- including Indian companies -- should be presented in a transparent manner before Parliament for approval, Pokharel said.

The Maoists have demanded contracts and agreements on the West Seti, Upper Karnali, Aurn III Upper Karnali and Upper Marsyangdi among others should be presented for deliberations in Parliament's committee on Natural Resources.

These projects were being selected and developed through tender process at the initiative of Nepal Electricity Authority.

Meanwhile, the Federation of Nepalese Chamber of Commerce and Industry (FNCCI) and Nepal India Chamber of Commerce and Industry (NICCI) have expressed serious concern over the Maoists' announcement to obstruct the operation of various hydropower projects.

FNCCI chairman Kush Kumar Joshi asked the Maoists to withdraw their decision.

Such things will discourage foreign investment in the hydropower sector at a time when the country is in the dire need of foreign capital and technology to fulfil the domestic resource gap, the NICCI said in a statement.

Commonwealth Games tarnishing India's global image: Moody's

Concerns over security and ill- preparedness for the Commonwealth Games next month has tarnished India's global image and may hurt its reputation as an investment and tourist destination, says Moody's.

"Concerns regarding safety, security and site preparedness are tarnishing the country's global image... India's reputation as a tourist and investment destination could be damaged," said Moody's Analytics, a unit of global rating agency Moody's.

The comments came amid criticism of lack of preparedness for the Games that are to be held here between October 3-14. About 9,000 athletes and officials from 72 nations are expected to participate.

The run-up to the CWG has been mired in controversy, including corruption charges against the Games Organising Committee, poor quality of construction of Games' facilities and sanitary issues with the Games village.

"Confidence in India's infrastructure, its capacity to organise large events, and its reputation as a tourist destination have all been brought into question," Moody's said.

Earlier this week, an under-construction foot overbridge collapsed outside the Jawaharlal Nehru stadium, the main venue for the mega event, injuring 27 people.

"Fears regarding safety and security have been upstaged by more immediate concerns about India's preparedness to host the event, following the collapse of a pedestrian bridge allegations of widespread corruption and revelations that the athletes' housing was unfinished days before competitors are scheduled to arrive," Moody's said.

Also there are threats of pull out by athletes from teams from Canada, England and New Zealand, while some squads have have delayed departure.

"The decision by a number of individual athletes to pull out... have dominated headlines at a time when India should have been showcasing its rising economy, recent infrastructure development, and improved business environment," it said.

The global agency said that the multi-billion dollar investment in the CWG would spur economic activity in 2010 through infrastructure investment, tourism promotion, and a general rise in household sentiment that would buoy retail spending.

"Benefits were expected to continue after the closing ceremony through increased global exposure and an improved international image," it added.

However, it added, "the fiasco is undermining the anticipated benefits of hosting a major international sports event."

The negative publicity could deter foreign investment and give multinational businesses considering expanding in India a reason to think twice, Moody's said.

India infrastructure at crossroads
MUMBAI: Infrastructure in India is key to realising the country's potential but bureaucracy, tough financing and hesitant overseas investment have slowed development in the sector, calling into question the future of India as a powerhouse.

The stakes are huge: Asia's third-largest economy has said it needs to double infrastructure spending to $1 trillion in the five-year period starting 2012, but its record is chequered with a history of missed deadlines, red tape, and massive cost overruns.

With an economy growing at 8.5 percent and a fast-urbanising population of 1.2 billion, the need to speed project approvals, implement new financing models and lure foreign investors is increasingly acute.

While the opportunity is clear in a country with choked roads and frequent blackouts, investors are wary, given the history of missed deadlines and red tape.

The government is struggling with a fiscal deficit, rising raw material costs and bidding wars for projects are hurting profits, and risk-averse foreign investors are shying away from committing long-term funds.

"The gap between what we are delivering and what we need is fairly high," said Manish Agarwal, executive director at global advisory firm KPMG.

"A number of steps are being taken. But the issue is: will they succeed and happen fast enough?"

Is red tape getting better or worse? Which sectors are attracting most interest? How do returns compare with similar projects globally? How do sector companies attract foreign investment in large projects? Are the challenges forcing investors and developers to look overseas instead?

These will be some of the questions that top industry executives, investors and policy makers discuss at the fifth annual Reuters India Investment Summit on Sept 27-29, with infrastructure as its central theme.

India spends about 6 percent of its GDP on infrastructure, less than several countries in Asia, and nearly half of the 11 percent invested by larger rival China.

There are ambitious plans to boost this to 10 percent by 2012, with private sector investment contributing a much higher share.

"The issues are at different levels. There are issues at the policy level itself, in other sectors it is a question of user charges not being adequate. For others, there is not enough pipeline of bankable projects," KPMG's Agarwal said.

"There are many challenges in the implementation of infrastructure projects in India," Credit Suisse said in a note to clients on Friday.

"Key risks...are in pre-construction phase for power projects, regulatory overhang in airports and highly competitive bidding reducing returns in road projects," it said.

Fin inclusion, UID to be dovetailed for greater benefits
Two of the Government's most ambitious schemes--the financial inclusion plan of catering to the unbanked population and the Nandan Nilenkani-headed UID project will be integrated for better benefits to the people.

"The financial inclusion plans will be dovetailed with the UID project and the bank accounts will also be used for the delivery of various government social benefit schemes like NREGA and old age pensions," an Indian Banks' Association (IBA) press release said quoting the Additional Secretary in the Department of Financial Services, Rahul Singh.

Singh chaired a meeting at the Indian Banks Association (IBA) office attended by the chiefs of eight public sector banks from western India, including the country's largest lender State Bank of India.

He also expressed confidence that the target of taking banking services to 73,000 habitations with population of over 2,000 will be achieved by March 2012.

"All of them (the banks) feel that they are well prepared and on the right track to meet the goals. Everybody has been allotted villages to be covered and formulated strategies which were discussed at a review on Thursday," Indian Banks Association (IBA) Chief Executive, K Ramakrishnan, told PTI.

He said the banks have divided their targets into two--one each for this fiscal and the next.

"Most of the time during the first six-months has gone in getting the infrastructure, training people and putting up the technology infrastructure in place. Once this is done, you will see much more momentum," another IBA executive said.

Govt okays FDI proposals worth Rs 2,727 crore
The government has approved 24 foreign direct investment proposals worth Rs 2,727.41 crore, including Rs 1,100 crore investment in power sector by Asian Genco Pte Ltd of Singapore.

Based on the recommendations of Foreign Investment Promotion Board (FIPB), the government has rejected 12 proposals and deferred 22 proposals, an officials statement said ThuRs day.

Asian Genco's proposal to set up a company in India with an investment of Rs 1,100 crore has been given the green signal. It will accelerate the company's investment in power sector in India.

NDTV Lifestyle Holdings' proposal to raise Rs 186 crore through induction of foreign equity has also been approved. The company plans to raise the money for uplinking and broadcasting of non-news and current affaiRs programmes.

Other approved proposals include Housing Development and Infrastructure Limited's plan to raise Rs 747.50 crore for development of residential and commercial projects. The company is involved in slum rehabilitation and airport development.

Jagran Media Network Pvt. Ltd's plan to raise Rs 225 crore and Kal Media Services Pvt. Ltd's plan to raise Rs 3,96 crore foreign funds have also been approved.

India Inc to gain as cash-rich govt may borrow less in second half

NEW DELHI: A stronger-than-budgeted growth in revenues could see the government borrow less from the market in the second half of the fiscal, leaving more funds for private borrowers amid rising signs of a pickup in investment activity.

The finance ministry and the central bank officials will meet on September 23 to decide on the borrowings calendar for the second half.

The buoyancy in indirect and direct tax revenue suggests that we will exceed the target for the year, said a finance ministry official, adding that the Rs 40,000-crore disinvestment is likely to be met.

The bulk of the Rs 65,000-crore windfall from the auction of 3G and broadband spectrum has already been consumed by the extra expenditure proposed by the government.

The government is, therefore, likely to use the extra revenue to pare down the fiscal deficit, budgeted at 5.5% of GDP. "The government has got additional revenues so it may borrow less," said D K Joshi, Chief Economist, Crisil. The government has already completed Rs 2.63 lakh crore of the total borrowing of Rs 4.57 lakh crore for the fiscal.

If the government decides to borrow less, it will leave more funds for private hands just when investments look to be picking up, as evident from increase in production and import of capital goods.

Year-on-year credit growth was up 19% but part of it because of the funding of the 3G.

Lower borrowings from the government will also help reduce pressure on interest rates as the Reserve Bank of India tightens monetary policy.

The yield on ten-year benchmark paper has inched up after the central bank has lifted rates five times this year by a total of 1.25 percentage points.

"If borrowings are lower due to higher revenue collection, then the bond yield will decline in the short term," said Alex Mathew, research head, Geojit BNP Paribas.

Indirect taxes, including import duties, excise duty and service tax, collections have grown by over 46% in the April-August and look all set to cross the budgeted Rs 3.15 lakh crore.

Though direct tax collections have grown by about 15% in April-August, a tad higher than the required about 14%, but with growth expected to pick up in the third quarter finance ministry officials expect to be well within reach of the budget target and could even exceed it marginally.

With a mega Coal India initial public offer, a big ticket stake sale in blue chip oil public sector units such as ONGC and Indian Oil Corporation and a follow on public offer of SAIL, government's disinvestment proceeds are on track to achieve the budget estimate of Rs 40,000 crore. The airwave auction that brought Rs 1,00,000 crore into the government kitty much more than the anticipated Rs 35,000 crore also provides enough comfort. Though, the expenditure demands have eaten into a substantial part of this money the government still has some buffer here.

The policy bias within the finance ministry is also in favour of retraining the growth in expenditure so there could be some tightening of purse strings over the next six months as the government begins its budget exercise.

"..there is a need to contain growth in expenditure so as to achieve a lower than budgeted level of fiscal deficit that could send appropriate market signals to investors, which is critical in sustaining growth in the medium term," said recently released monthly economic report by the finance ministry.

Rice production may go up 6%, pulses 33%

NEW DELHI: The farm ministry's first advance crop estimates for this kharif have projected a bumper output, which should help cool food inflation running at over 15%.

Good rainfall across the country, barring a few states in the east, has led to a sharp increase in cropping that is expected to yield a substantially higher production of nearly all food items.

The production of rice is projected to go up 6% to 80.4 million tonne while output of pulses is expected to rise 33% to six million tonne, data released by government showed on Thursday.

Sugarcane production growth has also been pegged at 17%, spurring hopes of lower sugar prices. The country has so far received 4% more rainfall than the long-term average and the good soil moisture is expected to help the rabi crop as well. The planning commission expects the farm sector to grow 5-6% in the current year.

However, food and farm minister Sharad Pawar said on Thursday that despite the expected bumper crop, the Centre was unlikely to rush into taking decisions on removing export restrictions on several crops, including sugar, rice and wheat, at this stage.

The first advance estimates for the year is based largely on the sowing estimates and tends to overestimate production. A reasonable idea is available by the third estimates of the year.

Besides, the erratic monsoon has caused heavy floods in the north, which could also affect production if water does not clear quickly and replanting is not done soon.

About 78 districts countrywide are also affected by drought. With food inflation at 15.46% for the week ended September 11, the government the government is reluctant to take any decision that could push up prices.

At 114.63 million tonne, the expected kharif production in the current year is about 15 million tonne more than the first advance estimates and an increase of 11 mt over the 4th estimates of 2009-10.

Cotton production, too, is bumper at an estimated 335 lakh bales, 96 lakh bales more than the fourth estimates for last year and sugarcane is pegged at 324.91mt.

SEZ developers may accelerate to meet DTC deadline: Assocham

The deadline of March, 2014, under the proposed Direct Taxes Code (DTC) for making new special economic zone units operational if they are to get tax benefits is likely to speed up development of these SEZs by entrepreneurs, a report said.

"In order to meet the time lines proposed in the Direct Taxes Code, developers and investors are likely to fast track the development of SEZs to meet the unit operational deadline of March, 2014," a report by industry chamber Assocham said.

The DTC Bill, which was tabled in Parliament in August, proposed that units in SEZs that commence commercial operations by March, 2014, shall be allowed profit-linked deductions permitted under the Income Tax Act, 1961.

It also proposed that SEZs notified on or before March 31, 2012, will get income tax benefits.

With SEZs attracting investments of over Rs 1.66 lakh crore, industry sources said the income tax benefit provided in the SEZ Act, 2005, is the major attraction for investors.

Assocham further said that demand for offices in the SEZs is expected to be low in the next 3-6 months, as occupiers are likely to rework their real estate strategies in the wake of the new time lines proposed in the DTC.

The report said that while non-extension of profit-based tax incentives to new SEZs is a definite "setback" to the overall SEZ scheme, it is a step forward towards rationalisation prior to introduction of a consistent tax policy.

"The real estate market in India is likely to adjust to the changing circumstances once DTC comes into force and then see a sustained demand momentum until 2014 from developers as well as occupiers," the report said.

The government has given formal approval for setting up about 580 SEZs, of which 122 have become operational.

SEZ approval process to go online from Oct: Commerce official

Getting approvals for setting up units in SEZs will be done electronically from next month - a move which will help entrepreneurs reduce transaction costs, a senior Commerce Ministry official said on Thursday.

"Special Economic Zones (SEZs) online means all approvals for setting up units or the infrastructure facilities will be done electronically," Additional Secretary in the ministry D K Mittal said at an Assocham function here.

Also considered as a green initiative, it would help the units reduce transaction cost and time, he said.

"The benefit would be that units would be able to do transactions very fast. Their transaction cost will be reduced dramatically...We expect that by middle of next month we will be fully on that system," Mittal said.

The data collection and collation will also become easier for everybody, he said, adding "everything will be electronically, whether it is a shipping bill or bill of entry."

Mittal further said that the ministry had asked all the Development Commissioners (DCs) to hold monthly meetings with officials of operational units to address their problems.

"We have asked our DCs to go to the notified zones at least once a month and have an open house discussion. This should start from October 1," he said.

Mittal also asked the developers to market SEZ scheme to attract more investments from abroad.

"We did not find developers doing enough marketing to attract investments for units. If you are not able to spend money on marketing, then how do you get units (in SEZs) and how do you get your money back," Mittal said.

Direct employment in SEZs has gone beyond 5.5 lakh people and investments have crossed Rs 1.66 lakh crore.

Exports from 122 operational SEZs in the last fiscal were valued at Rs 2.20 lakh crore.

India wary as West plots new climate moves ahead of Cancun
NEW DELHI: With all key countries discounting the possibility of a complete new global deal on climate change at Cancun, Mexico, in November, US and other rich countries have begun closed-door parleys to instead discuss a brief but game-altering 'Mexico Mandate'.

There are indications that the 'Mexico Mandate' could set new ground rules for crucial negotiations leading to a final new deal by December 2011. The move has not gone down well with the Indian government which sees pitfalls in allowing decisions on issues closer to developed countries' interests at Cancun while concerns of the South are unresolved.

The mandate could be in form of a series of decisions that all countries accept instead of hammering out a comprehensive new package. The Indian negotiators feel it could force negotiations to depart away from Bali mandate which was concluded after a heated debate in 2009 with developing countries managing to push in concerns of equity and development rights even as US and others fought hard to pin responsibility for mitigation on emerging economies.

Since Bali, negotiations that led up to and after Copenhagen Accord are seen by developing nations, especially BASIC nations — China, India, Brazil, South Africa — as a consistent attempt to reduce differential in responsibilities between rich and poor nations.

With recession having smacked the political will out of Northern countries to take any strong mitigation action and Barack Obama unable to pull off a domestic legislation on greenhouse gas emission reduction targets, Cancun is expected to produce a set of decisions on select issues. The US is seen to push for a decision that sets up strict scrutiny regime monitoring developing nations' economies while a deal on forestry and technology sharing is seen as sops to poor nations. India so far remains wary of such decisions where key issues of strong mitigation targets by developed countries and their financial commitments under UN Convention remain unresolved.

Climate change focus shifts to "post-Cancun": Ramesh

NEW YORK: Noting that "no major breakthrough" was possible at the climate change conference in Cancun, environment minister Jairam Ramesh said that the focus of the international community had now shifted to what measures needed to be taken "post-Cancun".

The minister, who initiated the discussion at the Major Economies Forum in New York yesterday, pointed out that the discussion at MEF had revolved around discussing what would be the likely outcomes at Cancun, Mexico.

"Clearly now the focus is on post-Cancun...we recognise that there is no breakthrough possible in Cancun but let's now try to cut our losses and see what we can do after Cancun," Ramesh said.

"So we get a set of COP (Conference of Parties) decisions at Cancun and let those decisions serve as a further basis of further action post-Cancun," he said, after the MEF meeting.

The countries present in the two-day MEF meeting are Australia, Brazil, Britain, Canada, China, the European Union, France, Germany, India, Indonesia, Italy, Japan, Mexico, Russia, South Africa, South Korea, and the United States.

Countries that come to the conference in Cancun, later this year, are expected to produce a legally binding treaty to combat climate change, which the conference in Copenhagen failed to do.

Instead, two-weeks of negotiations yielded the non-binding Copenhagen Accord, which was produced by 29 countries, but principally drafted by the United States, China, India, Brazil and South Africa, in the last few hours of the Conference.

It was criticised by certain countries including Bolivia, Venezuela, Nicaragua and Cuba for having left the majority of the nations out of the negotiating process, and led to charges of a "trust deficit" between the developed and developing world.

Key elements of the Accord included a limit 2 degree rise of global temperature, 100 billion dollars on finance in long term finance to developing countries and 30 billion dollars to short-term finance to the poorest and most vulnerable countries.

The minister reiterated that one of the reasons for the lack of progress in Cancun is the absence of any action towards dispensing of $30 billion by developed countries promised at Copenhagen.

India and other emerging economies do not benefit from this aid. "We should be realistic of what you can expect to do in Cancun," Ramesh said.

World powers to tackle climate amid skepticism
NEW YORK: The 17 nations responsible for 80 percent of carbon emissions blamed for global warming will seek to unblock stalled climate negotiations next week but analysts expect little progress.

The two-day Major Economies Forum on Energy and Climate kicks off Monday and will include top government envoys, including US special envoy for climate change Todd Stern.

US President Barack Obama launched the meetings to facilitate climate talks in the wake of last year's disappointing United Nations conference in Copenhagen.

The successor conference to the Copenhagen meet is set for this November in Cancun, Mexico.

"I don't think anyone is expecting any major announcement," said Michael Levi, an analyst with the Council on Foreign Relations.

"This is a working meeting... a lot of important players are at the same place at the same time" during the United Nations General Assembly, he said.

Levi said the envoys would not seek to resolve the fierce debate over climate change but rather find ways to better define the issues, acknowledging the Cancun meeting would likely be another stalemate.

"No one is going to crack a big deal at this," he added.

Environmentalist Bill Mekibben, co-founder of the environmental group 350.org, said the US Congress's failure to pass a law to combat climate change made it "very difficult" to clinch a strong agreement in Cancun.

"I think that the next two years will be a disappointing time in terms of actions and that we will have to use that time to build a powerful movement to get real action the next time there will be a political window that opens up," he added.

Levi warned that a period of uncertainty could follow the November mid-term legislative elections in which Republicans are poised to retake control of the House of Representatives from Obama's fellow Democrats and to increase their numbers in the Senate.
Last June, the House approved a bill that would launch the country's first nationwide "cap-and-trade" system that restricts carbon emissions blamed for global warming and allows trading in credits.

The Senate has yet to offer companion legislation, amid opposition from Republicans and Democrats from states dependent on the coal and hydrocarbon industries.

"Real change contradicts the business model of the fossil fuel industry," Mekibben said, saying the industry was too powerful for Congress to effectively tackle reductions in greenhouse gas emissions. He urged more global action to create a "mass movement" in support of cutting emissions.

In October 2009, his 350.org organized a major day of political action, with 5,245 protests and other events across 181 countries.

Environment ministers from 45 countries are also scheduled to meet in Geneva in September at the invitation of the Swiss and Mexican governments.

And negotiators from the 194 signatories to the United Nations Convention on Climate Change are to meet in Tianjin, China for a final preparatory round of talks in October.

India bribed 72 nations to get Delhi CWG: Report

MELBOURNE: India bribed 72 Commonwealth countries $100,000 each to get the hosting rights for the scandal-hit 19th edition of the Games which will start in Delhi from October 3-14, a media report claimed here on Thursday.

A report in the Daily Telegraph claimed that Delhi pipped Hamilton in the bid after offering huge sums of money to the 72 Commonwealth countries during the final presentation in Jamaica.

The report also said that Australia received a kickback of $125,000 from India.

"Delhi sealed the right to host the Games when their delegates emerged at the final presentation in Jamaica and offered all 72 nations $100,000 (then about $140,000) each for athlete training schemes if they were the successful bidders," the newspaper reported.

"The money, subsequently paid to all nations, was not significant to Australia because it had already decided to vote for India and the payment was not an exceptionally large one.

India alone responsible for mess not CGF: Hooper

NEW DELHI: The CGF CEO Mike Hooper on Thursday refused to take any blame for the mess in which the Delhi Commonwealth Games finds itself, saying India alone is responsible for all the problems surrounding the mega event.

Hooper said the prime responsibility of delivering the Games lies alone with India.

"Absolutely. India has made a massive investment in trying to deliver the Games ... But at the end of the day the responsibility for delivering on the obligations, promises made sits with India," Hooper said.

"Certainly our job is to work with (OC), get things done. Implementation and delivery is the responsibility of India the Organising Committee, the government of India and government of Delhi etc.," he told NDTV.

The Games were almost pushed to the brink of disaster but the participating teams are coming up with assurances that they will soon reach the national capital of India for the Games.

A shooting incident in which two Taiwanese were injured, a collapsed overbridge just outside of main venue Jawaharlal Nehru stadium and falling of tiles from the false ceiling at the weightlifting venue and heavy criticism of the Games Village have spoiled the build-up to the Games.

Before that construction delays and corruption allegations had hurt the preparations badly.

'No justification for Indian cos on US entities list'

WASHINGTON: With deepening and strengthening of strategic relationships between India and the US, there is no justification for keeping Indian companies in the entities list, Union Commerce and Industry Minister Anand Sharma has said.

"There is no justification of the continuation of Indian companies on the entity list," Sharma told a group of Indian journalist after his meetings with top US officials including Trade Representative Ron Kirk.

"The issue of export controls particularly the need to removal of Indian entities after the understanding and agreements that the two countries have reached in strategic field in particular was raised earlier. It did figure, not in the trade policy form, but in the closed bilateral," Sharma said when asked bout the continuation of Indian companies in the entities list.

"We do hope that there will be action. They are aware of the significance of it and the need. The Indian viewpoint has been articulated and reaffirmed unambiguously. We hope that (contradiction between cooperation and entity list) will be corrected," Sharma said.

"We have said that India's position is well known and appreciated because Washington also attaches equal significance to this strategic partnership with India," he said.

Sharma who attended a number of meetings here said during the meetings the two countries also discussed the idea of a Indo-US Treaty of Trade and Investment.

"We have between the two countries signed a framework co-operation agreement on trade and investment. We have suggested - both the sides discussed - that we should upgrade and start discussing seriously into a treaty of trade and investment. We hope that in a structured format this would be taken forward in the coming months," he said.

Diabetes drug banned abroad, test for India

New Delhi, Sept. 23: Europe today banned and the US imposed severe restrictions on an anti-diabetes medicine called rosiglitazone amid concerns that it increases the risk of heart attacks and strokes, but doctors say the drug is widely used in India.

The European Medicines Agency (EMA) suspended marketing approval to the drug and said doctors should stop prescribing medicines that contain rosiglitazone. It asked patients on this medication to consult their doctors to discuss suitable alternatives.

The US Food and Drug Administration (FDA) said rosiglitazone would now be restricted to patients unable to control their diabetes with other drugs. "The FDA is taking this action to protect patients after a careful effort to weigh benefits and risks," FDA commissioner Margaret Hamburg said.

The announcements follow independent reviews by the EMA and the FDA of data showing elevated risks of heart failure and strokes associated with the drug.

But diabetes specialists believe the drug continues to be marketed aggressively in India.

"The use of rosiglitazone in India is still widespread, mainly through general practitioners and doctors who are still not so well aware of its potential risks," said Anoop Misra, a consultant endocrinologist and director of the Centre for Diabetes and Obesity Studies in New Delhi.

Misra said most endocrinologists and senior physicians in large metros were not prescribing rosiglitazone any more because of greater awareness in medical circles and even among the public. "But there is still aggressive marketing by pharma company representatives who try to influence junior doctors and general practitioners who are not in touch with recent research data, telling them that it is not harmful," Misra said.

Misra and other endocrinologists in India said they would now wait and watch Indian drug regulators' response to the FDA and European decisions.

Under the new FDA restrictions, doctors in the US will now have to attest and document each patient's eligibility to receive rosiglitazone. Such a rigorous follow-up and documentation would be impossible in India, a senior endocrinologist in Delhi said.

European regulators had earlier restricted the drug as a second-line medication, to be given only to patients in whom other drugs did not work. In view of the restrictions already in place, the EMA panel examining the issue has said it could not identify any additional measures that would reduce the cardiovascular risks of the drug.

The EMA panel said the benefits no longer outweigh the risks and suspended its market approval.

The FDA has also halted a controversial clinical trial that was to compare rosiglitazone with another anti-diabetes medication called pioglitazone. Several medical centres across India were to be part of this clinical trial, as The Telegraph had reported on May 29 this year.

Experts in India and North America had described the clinical trial as unethical, saying it was ignoring a wealth of data that suggested that rosiglitazone carried greater risk of harm than pioglitazone.

Both drugs provide effective blood glucose control. But over the past three years, studies had shown that rosiglitazone carries a higher risk of heart failure than pioglitazone.

A joint statement last year from the American Diabetes Association and the European Diabetes Association had advised against the use of rosiglitazone in the control of diabetes.

FIIs must stop acting on behalf of few individuals: SEBI

Capital market watchdog SEBI said foreign institutional investors have to, by October 1, end the practice of investing money collected from a single or few investors in stocks, as a guard against manipulation.
Rejecting the demand from FIIs for extension of the October 1 deadline for compliance with the new rules, SEBI Chairman C B Bhave said FIIs will have to register afresh under a structure conforming to the new norms.
The new guidelines require that FIIs or each of their sub-accounts must have not less than 20 investors, except for a few entities like pension funds.
There have been concerns that a few high-networth individuals have been playing the stock market using the FII route.
The norms also require that no single investor accounts for 49 per cent of the fund raised for investment.
"Foreign Institutional Investors (FIIs) have to comply with October 1 deadline," Bhave told reporters on the sidelines of a merchant banking industry function here.
On the surge in stocks, driven by huge investment inflows from the FIIs, Bhave said, "As of now we are not concerned with the trail of money into the domestic market."
He, however, said that the surge has not resulted in any trade settlement related problems and that the regulator was keeping a close watch.
Besides, on the issue of bringing down the IPO listing period to seven days from current 20 days, he said that it is not a mandatory, but an observation. "Our panel is looking into the practicality of its implementation. Our panel is likely to come out with its report by November post which we will take a call."

HC questions Centre on inaction on illegal mining

The Karnataka High Court today questioned the Centre as to why it had not taken suo moto action in checking illegal mining under the relevant act. Hearing petitions by mining firms challenging the state government''s recent ban on export of iron ore, the bench wanted to know why the Centre did not act on its own to check illegal mining under section 30 of the Mines and Minerals (Development and Regulation) Act 1957 when it says that state government had no powers to ban exports of iron ore.
The bench comprising Chief Justice J S Khehar and Justice J S Khehar directed the central government counsel Dinesh Kumar to furnish the reply by October 1 and adjourned the case. "This is an extensive litigation and we want to know the responses from all the parties involved," the judges said.

Frustrated Ayodhya wants quick decision

THE Supreme Court decision to defer the verdict might has come as a temporary relief for the Uttar Pradesh government and the Faizabad district administration, but has frustrated residents of Ayodhya.
"It is a frustrating situation for us. We are losing business every day. We request the court to announce the verdict at the earliest. Be it in favour of Hindus or Muslims, it should be spelled out so that we can go back to our normal life and business," Prabhunath Yadav, a shopkeeper at the Ramjanmabhoomi market, said.
The number of visitors to the temple town has dropped in the past few days.
"Normally, over 5,000 devotees come here every day, giving us ample business. But the figure has dropped to barely 100," Vikas Chand, another shopkeeper, said.
Though the situation remains calm in Ayodhya, it's normal in rest of the district.
"For us, our children's education is of utmost priority. Nobody wants violence," Rahman Khan, who runs a roadside eatery, said. Sarita Rai, who teaches at a private school in Faizabad, said classes in schools and colleges won't be disrupted even on the judgment day.
Manoj Singh, an auto rickshaw driver, said: " It is a hype created by the media and politicians. People are going to their work and life is normal here. But yes, police presence has gone up." However, traffic on the roads was thin on Thursday compared to other days. "The number of vehicles on the roads have come down by 80 per cent," D. P. Mishra, a traffic constable, said.
The district administration, under intense media glare, is playing it safe. "The forces will remain here as the next date of the verdict is not far off," district magistrate M. P. Agarwal said, referring to over 50 companies of paramilitary forces and UP policemen camping across Faizabad district to maintain law and order.

The Unique Identification Authority of India (UIDAI) (Hindi: भारतीय विशिष्ट पहचान प्राधिकरण), is an agency of the Government of India responsible for implementing the envisioned Multipurpose National Identity Card or Unique Identification card (UID Card) project in India. It was established in February 2009, and will own and operate the Unique Identification Number database.[1] The authority will aim at providing a unique number to all Indians, but not smart cards.[2] The authority would provide a database of residents containing very simple data in biometrics.[3]

The agency is headed by a chairman, holds a cabinet rank. The UIDAI is part of the Planning Commission of India.[1][4] Nandan Nilekani, a former co-chairman of Infosys Technologies, was appointed as the first Chairman of the authority in June 2009.[5]. Ram Sewak Sharma, an IAS Officer of Jharkhand Government cadre has been appointed as the Director General and Mission Director of the Authority. He is known for his best effort in e-Governance project for Jharkhand State and working as an IT secretary he received a number of awards for best Information Technology Trends State in India.

[edit] Coverage, goals and logistics

It is believed that Unique National IDs will help address the rigged state elections, widespread embezzlement that affects subsidies and poverty alleviation programs such as NREGA.[6] Addressing illegal immigration into India and terrorist threats is another goal of the program.[7]

Most reports suggest that the plan is for each Indian citizen to have a unique identification number with associated identifying biometric data and photographs by 2011.[8] However, other reports claim that obtaining a unique number would be voluntary, but those that opt to stay out of the system "will find it very inconvenient: they will not have access to facilities that require you to cite your ID number."[2]

Government issued IDs are fragmented by purpose and region in India, which results in widespread bribery, denial of public services and loss of income, especially afflicting poor citizens.[9] As the unique identity database comes into existence, the various identity databases (voter ID, passports, ration cards, licenses, fishing permits, border area id cards) that already exist in India are planned to be linked to it.[2] The Authority is liaising with various national, state and local government entities to begin this process. The Union Labor Ministry has offered its verified Employment Provident Fund (EPFO) database of 42 million citizens as the first database to be integrated into the unique ID system.[10]

Other UID projects implemented on a smaller scale in India can also facilitate in the development of the national project. An example is a project developed by Wolf Frameworks Cloud Computing vendor and Social Education and Development Society (SEDS) for profiling and generating Unique Identification for more than 40,000 members in the Anantapur district of Andhra Pradesh. [11]

The UID will link a person's Passport Number, Driving License, PAN card, Bank Accounts, Address, Voter ID etc and all this information will be checked through a database. So, if someone has a different addresses on PAN and driving license, is liable to get caught. Those who will opt out of this program will have much inconvenience in doing business, operating bank accounts and other offices which will require a UID.

UIDAI has headquarters in Delhi and a technology centre in Bangalore. It also has 6 regional offices in Chandigarh, Delhi, Lucknow, Ranchi, Guwahati, Mumbai, Hyderabad and Bangalore.[12]

UID project is known as AADHAAR meaning 'support', and its logo is a yellow sun with a fingerprint embedded in its centre. [13]

[edit] Projected costs and business opportunities

One estimate of the cost to completely roll-out National IDs to all Indian residents above the age of 18 has been placed at  150,000 crore (US$32.55 billion).[14] A different estimate puts it at US$ 6 billion.[15] A sum of  100 crore (US$21.7 million) was approved in the 2009-2010 union budget to fund the agency for its first year of existence.[1]. UID has received a huge boost with Dr Pranab Mukherjee, Minister of Finance, allocating Rs 1900 crore to the Unique Identification Authority of India (UIDAI) for 2010-11.

Initial estimates project that the initiative will create 1000 new jobs in the country, and business opportunities worth  6,500 crore (US$1.41 billion) in the first phase [8] of implementation.

There are many potential privacy fallouts of this project, not the least of which is triggered by the Government's official plan to link the databases together.

Although there is sometimes a tension between individual privacy rights and national security, international law and India's domestic law expressly set a standard in tort law and through constitutional law to protect an individual's privacy from unlawful invasion. Under the International Covenant on Civil and Political Rights (ICCPR), ratified by India, an individual's right to privacy is protected from arbitrary or unlawful interference by the state.

The Supreme Court also held the right to privacy to be implicit under article 21 of the Indian Constitution in Rajgopal v. State of Tamil Nadu. Moreover, India has enacted a number of laws that provide some protection for privacy. For example the Hindu Marriage Act, the Copyright Act, Juvenile Justice (Care and Protection of Children) Act, 2000 and the Code of Criminal Procedure all place restrictions on the release of personal information. Privacy is a key concern with respect to the MNIC scheme as all of an individual's personal information will be stored in one database where the possibility of corruption and exploitation of data is far greater than when having the information disbursed.

Risks that arise from this centralization include possible errors in the collection of information, recording of inaccurate data, corruption of data from anonymous sources, and unauthorized access to or disclosure of personal information.Other countries with national identification systems have confronted numerous problems with similar risks such as trading and selling of information, and India, which has no generally established data protection laws such as the U.S. Federal Privacy Statute or the European Directive on Data Protection, is ill-equipped to deal with such problems. The centralized nature of data collection inherent in the MNIC proposal only heightens the risk of misuse of personal information and therefore potentially violates privacy rights. In consideration of the risks involved in the creation of a centralized database of personal information, it is imperative that such a programme not be established without the proper mechanisms to ensure the security of each individual privacy rights. Unfortunately, India's proposed MNIC programme lacks any provision for judicial review at the present time. Without credible and independent oversight, there is a risk of 'mission creep' for MNICs; the government may add features and additional data to the MNIC database bureaucratically and reflexively, without reevaluating the effects on privacy in each instance.

Probe into 2G scam fair and impartial: CBI tells SC

The CBI today asserted in the Supreme Court that it was probing in a "fair and impartial" manner the alleged irregularities in the 2G spectrum licences distributed in 2008 by Telecom Minister A Raja, and it was not in a position at this stage to deny or agree with the charges. The agency filed an affidavit in this regard and mentioned that it was placing in a sealed envelope the status report about investigations into allegations that there was a Rs 70,000-crore scam in allotment of 2G spectrum licences, in which Raja''s name cropped up.
The affidavit was filed by the CBI in compliance with the September 13 notice to the Centre, Raja and others. Sources said that the agency in its affidavit has maintained that "the investigation is being carried out in the right earnest and in a fair and impartial manner without even in the slightest manner showing any partiality to any suspect/ accused, who may ultimately be involved in the commission of the any of the mentioned offence".
They further said CBI has also maintained that the facts disclosed in the status report would show that probing this case involves a deep investigation into a very complex and vastly spread issue. "The enormity of material and evidence mentioned but would also justify the request being made that such investigations require a tremendous amount of work and is, by the very nature of the material and evidence, time consuming in order to arrive at correct conclusion of the culpability, if any, of the suspects and accused persons.
" Sources associated with the matter said the Central Bureau of Investigation (CBI) was "cautiously" moving in the case and at this stage it was not in a position to agree or deny the allegations as the probe was still going on. "We do not agree or deny anything till the investigation is going on," sources said.
In the affidavit it has been maintained that" it is the bonafide perception that disclosure of details of investigation, so far made, will be prejudicial to the interest of investigation", sources said. CBI further believes that if the avernments as urged in the petition are dealt in seriatim (one by one in order), the same is likely to prejudice the investigation since it will disclose the line of probe which may not be in the interest of investigation.
A bunch of petitions filed by an NGO, Centre for Public Interest Litigation (CPIL) and others had alleged that the Centre was trying to put a lid on the investigation into the alleged irregularities in spectrum licence allocation. The Supreme Court on September 13 had sought response within ten days from Raja, Department of Telecom, CBI, Enforcement Directorate and the Income Tax department.

D Raja to raise issue of tribal rights with C''garh CM

Senior CPI leader D Raja would meet Chhattisgarh Chief Minister Raman Singh on Monday to raise the issues of tribal rights and alleged police atrocities against them in the name of fighting Maoists. The visit comes against the backdrop of the arrest of several CPI activists in Dantewada district recently.
Raja, who would visit Dantewada and other towns in the state from tomorrow and hold meetings with party leaders and activists, would meet the Chief Minister on Monday. "It is a deliberate attempt to target the CPI and terrorise the tribals of the region by the state police," the party National Secretary told PTI here.
The party leadership, including General Secretary A B Bardhan, have also raised the issue with Prime Minister Manmohan Singh and sought immediate intervention of Home Minister P Chidambaram to get the CPI activists released forthwith. About 65 CPI leaders, including former MLAs, peasants, workers and tribals organisation and panchayat leaders, have been arrested "in the name of fighting Maoists" by the police particularly in the Dantewada region, Raja said.
Those arrested include senior CPI leader Kartam Joga, who was the first petitioner in a case against anti-Naxal outfit Salwa Judum.
