The apex court ordered CBI probe into six issues relating to corrupt practices being adopted for private gains.

The Supreme Court on Thursday directed the CBI to probe six issues relating to the conversations between corporate lobbyist Niira Radia and others and submit a report within two months.

A Bench of Justices G.S. Singhvi and V. Gopala Gowda ordered the CBI probe after examining the report of the Income-Tax department with reference to the criminal dimensions in the conversations.

The court had earlier sought the I-T department inquiry on a writ petition filed by industrialist Ratan Tata.

The court said, "Collusion between government officials and private interest is apparent after perusing the transcripts of the tapes."

The Bench, in its order, did not name the issues but merely indicated them as 1, 2, 4, 5, 6, 7 and 14 as the I-T department's report was in a sealed cover. During the course of hearing, the judges had asked the government to transcribe over 8,000 conversations in the tapes, but the I-T department, which set up a committee, informed the court that it could cover only a portion of the tapes. The committee's report was shared with the CBI on court directions. The CBI found several aspects of criminality which required to be probed further. The investigative agency suggested that some of them be referred to the States for probe but the Bench rejected the suggestion and asked the CBI itself to conduct the investigation.

On earlier occasions, the court had expressed concern that some of the conversations might even affect national security.

Besides the six issues referred to the CBI, the Bench referred to Chief Justice of India P. Sathasivam an issue relating to the judiciary and one issue to the Chief Vigilance Officer of the Mines Department.

The court posted the matter for December 16.


सुप्रीम कोर्ट ने नीरा राडिया के टेलिफोन की रिकॉर्ड की गई बातचीत के विश्लेषण के आधार पर छह मामलों की सीबीआई जांच का आदेश दिया है। गौरतलब है कि इस बहुचर्चित टेप कांड में सरकार के फैसलों को गलत ढंग से प्रभावित करने का आरोप उभर कर सामने आया था।


सुप्रीम कोर्ट ने कहा कि नीरा राडिया की बातचीत से सरकारी अधिकारियों और निजी उद्यमियों के बीच साठगांठ की गहरी पैठ का पता चलता है।


कोर्ट ने कड़े शब्दों का इस्तेमाल करते हुए कहा कि टेलिफोन की बातचीत से संकेत मिलता है कि लाभ हासिल करने के लिए निजी पक्षों ने भ्रष्ट तरीके अपनाए। जस्टिस जी एस सिंघवी की अगुवाई वाली पीठ ने इनकम टैक्स विभाग द्वारा सौंपे गए नीरा राडिया टेप की ट्रांसक्रिप्ट पढ़ने के बाद सीबीआई को यह आदेश दिया। कोर्ट ने कहा कि सीबीआई इन मामलों की जांच करके दो महीने के अंदर यानी 16 दिसंबर तक अपनी रिपोर्ट सौंपे।

इससे पहले 31 जुलाई को सीबीआई नेकोर्ट को बताया था कि नीरा राडिया की अलग-अलग लोगों से टेलिफोन पर हुई बातचीत का आपराधिक पहलू भी है। राडिया की इस बातचीत में अन्य लोगों के अलावा कुछ पत्रकार भी शामिल थे।


নয়াদিল্লি: টুজি স্পেকট্রাম কেলেঙ্কারির পর আবারও বিতর্কের কেন্দ্রে কর্পোরেট লবিইস্ট নীরা রাডিয়ার কথোপকথনের টেপ৷ এই কথোপকথন থেকে প্রশাসনের বিভিন্ন স্তরে আরও অনেক দুর্নীতির হদিশ পাওয়া যেতে পারে বলে মনে করে সুপ্রিম কোর্ট৷ ওই রেকর্ডিংয়ের মধ্যে অন্তত ১৪টি নিয়ে সিবিআইকে তদন্তের নির্দেশ দিয়েছে শীর্ষ আদালত৷ অত্যন্ত কঠোর অবস্থান নিয়ে শীর্ষ আদালতের বক্তব্য, ওই টেপের কথোপকথন থেকে প্রশাসন ও একাধিক বেসরকারি সংস্থানের মধ্যে অশুভ আঁতাঁতের কথা সামনে আসছে৷ অতএব এ নিয়ে তদন্ত অবশ্যই প্রয়োজন৷

গত ১৬ ডিসেম্বর নীরা রাডিয়া টেপের অনুলিখন বিচার করে দেখার জন্য একটি কমিটি নিয়োগ করেছিল সুপ্রিম কোর্ট৷ সেই কমিটির তদন্ত রিপোর্টের ভিত্তিতেই এ দিন সিবিআইকে এই নির্দেশ দেওয়া হয়েছে৷ আগামী দু'মাসের মধ্যে তদন্ত শেষ করে সুপ্রিম কোর্টে রিপোর্ট পেশ করতে হবে কেন্দ্রীয় তদন্ত সংস্থাটিকে৷ বিচারপতি জি এস সিংভির নেতৃত্বাধীন বেঞ্চ এ দিন বলে, 'প্রাথমিক তদন্ত থেকে প্রকাশ, ব্যক্তিগত মুনাফা ও স্বার্থের কারণে সরকারি আধিকারিকরা ও বিভিন্ন বেসরকারি সংস্থান দুর্নীতিগ্রস্ততার আশ্রয় নিয়েছে৷'

২০০৮-২০০৯ সালে নীরার সংস্থার বিরুদ্ধে কর ফাঁকি দেওয়ার অভিযোগের তদন্ত করতে তাঁর ফোনে আড়ি পাতে আয়কর দন্তর৷ আর এইভাবেই কেঁচো খুঁড়তে কেউটে বেরিয়ে পড়ার মতো সামনে আসে টুজি স্পেকট্রাম কেলেঙ্কারিতে নীরা রাডিয়ার বড়সড় ভূমিকা৷ প্রাক্তন টেলিকমমন্ত্রী এ রাজাকে ওই পদ পাইয়ে দিতে প্রশাসনের বিভিন্ন স্তরে একাধিক নেতা-মন্ত্রী ও বিভিন্ন সাংবাদিকের উপর প্রভাব খাটানোর কথাও সামনে আসে৷ তবে এই টেপ নিয়ে বিতর্ক এখানেই শেষ নয়৷ সিবিআই-এর হাতে যে ৫৮৫১টি কথোপকথনের রেকর্ডিং রয়েছে তাতে আরও একাধিক লেনদেনের ক্ষেত্রে অবৈধভাবে প্রভাব খাটানোর নিদর্শন রয়েছে৷ এই বিষয়গুলি নিয়ে বিস্তারিত তদন্ত হলে বিপদে পড়তে পারেন বহু নামজাদা ব্যবসায়ী থেকে কেন্দ্রীয় মন্ত্রীরাও৷ - সংবাদসংস্থা


सुप्रीम कोर्ट ने शुक्रवार को कहा कि कॉर्पोरेट घरानों के लिये संपर्क का काम करने वालीं नीरा राडिया की प्रभावशाली व्यक्तियों के साथ रिकॉर्ड की गई टेलिफोन बातचीत की जांच पड़ताल से पता चलता है कि यह सिर्फ 2जी स्पेक्ट्रम तक सीमित नहीं थीं और इससे रेलवे बोर्ड में सदस्यों की नियुक्ति सहित अनेक पहलुओं के बारे में पता चलता है।


कोर्ट ने दस सदस्यीय समिति की गोपनीय रिपोर्ट देखने के बाद कहा कि नेताओं, औद्योगिक घरानों और दूसरे लोगों के साथ राडिया की टेलिफोन बातचीत के विवरण की जांच से राष्ट्रीय सुरक्षा और रेलवे बोर्ड में सदस्यों की नियुक्तियों से संबंधित मसले का भी पता चलता है। जस्टिस जी एस सिंघवी और जस्टिस वी गोपाल गौड़ा ने कहा कि रेलवे बोर्ड के सदस्य से संबंधित हालिया घटना के बारे में भी राडिया की रिकॉर्ड की गई टेलिफोन बातचीत से पता चलता है।


जजों ने कहा, 'वास्तव में धन का भुगतान किया गया है।' साथ ही जजों ने सचेत किया कि सिर्फ एक पक्षीय नजरिया नहीं होना चाहिए और इसकी गहन जांच होनी चाहिए क्योंकि यह बहुत ही गंभीर मामला है। जजों ने कहा, 'राष्ट्रीय सुरक्षा के पहलू के संबंध में रिपोर्ट स्पष्ट नहीं है लेकिर बहुत ही गंभीर है और इस संबंध में टेलिफोन कॉल के विवरण की गहराई से छानबीन की आवश्यकता है। हम कोई ठोस सामग्री मिले बगैर इस संबंध में कुछ नहीं करना चाहेंगे।'


जजों ने कहा, 'वे एक अलग पहलू पर प्रकाश डाल रहे हैं। हमारा मानना था कि सब कुछ स्पेक्ट्रम आदि से ही संबंधित है लेकिन यह तो कहीं अधिक व्यापक और भिन्न है। कुछ मसलों को लेकर तो काफी गंभीर स्थिति है।'


कोर्ट ने कहा, 'राष्ट्रीय सुरक्षा के बारे में आपको (सीबीआई) बहुत ही सावधानी बरतनी होगी जिसके बारे मे हमने इंगित किया है। इस संबंध में ठोस तथ्य मिलने तक यह अटकल का मामला नहीं होना चाहिए क्योंकि इससे राष्ट्रहित को नुकसान होता है। इसमें शामिल एजेंसियों को इस मामले में गौर करने के लिये पर्याप्त अवसर मिलना चाहिए।


जजों ने कहा, 'हम इसी जांच दल को या आप जो दल चुने या फिर राडिया की बातचीत रिकॉर्ड करने वाली आय कर विभाग की शुरुआती टीम को रिकॉर्ड किए गए सारे टेप की जांच के लिए पर्याप्त समय देंगे।' कोर्ट ने इस मामले में मंगलवार को फिर सुनवाई करने का निश्चय किया है। इसके बाद ही कोर्ट राडिया के टेलिफोन रिकॉर्ड के टेप और उनके लिप्यांतरण का गहराई से जांच करने वाले विशेष जांच दल की शुरुआती जांच पर कोई आदेश देगा।


अतिरिक्त सॉलिसीटर जनरल पारस कुहाड ने कहा कि जांच के दायरे में आये बातचीत के कुछ बिंदुओं से अपराधिता के कुछ अंश झलकते हैं और इस संबंध में भ्रष्टाचार निवारण कानून के तहत मामले दर्ज किये जा सकते हैं। कोर्ट ने कुहाड से कहा कि इस रिपोर्ट को आय कर विभाग की ओर से पेश होने वाले दूसरे अतिरिक्त सॉलिसीटर जनरल एल नागेश्वर राव के साथ भी साझा किया जाए।


गैर सरकारी संगठन सेंटर फॉर पब्लिक इंटरेस्ट लिटीगेशंस के वकील प्रशांत भूषण ने आरोप लगाया कि रिकॉर्ड की गई बातचीत में सामने आये एक मामले को तो जांच ब्यूरो बंद करने वाला था। उन्होंने कहा कि हाइड्रोकार्बन के पूर्व महानिदेशक की बेटी की शिक्षा के बारे में पर्याप्त साक्ष्य थे कि एक औद्योगिक घराने ने उसे पोषित किया था लेकिन जांच एजेंसी इसे बंद करने का प्रयास कर रही है।


सुप्रीम कोर्ट मे कॉरपोरेट लॉबिस्ट नीरा राडिया की सरकारी अधिकारियों से बातचीत के 15 टेपों की सीबीआई जांच के आदेश दिए है। सुप्रीम कोर्ट ने राडिया टेप मामले में गहरी साजिश की आशंका जाहिर करते हुए कहा है कि औद्योगिक घरानों से ताल्लुक रखने वाली नीरा राडिया की नौकरशाहों और उद्यमियों और नेताओं के साथ बातचीत से पहले नजर में गहरी साजिश को पता चलता है। ऐसे में इस मामले से पर्दा उठना जरुरी है। सुप्रीम कोर्ट ने पूर्व कारपोरेट लॉबिस्ट नीरा राडिया के टेप में आपराधिक पहलुओं की सीबीआई जांच के आदेश दिए। न्यायामूर्ति जी. एस. सिंघवी की अध्यक्षता वाली शीर्ष अदालत की खंडपीठ ने सीबीआई को राडिया के टेप की जांच एजेंसी द्वारा की गई पड़ताल में पहचाने गए तथ्यों की जांच करने का आदेश दिया। टेप की जांच के बाद आयकर विभाग ने अपनी रिपोर्ट अदालत को सौंपी है। अदालत ने एक मामले को मुख्य निगरानी अधिकारी के खान विभाग को प्रेषित किया, जबकि एक मामला भारत के प्रधान न्यायाधीश को प्रेषित किया गया है। जांच एजेंसी को टेप की जांच करने वाले छह सदस्यीय दल द्वारा चिन्हित किए गए छह मुद्दों पर जांच करने का आदेश देते हुए अदालत ने कहा, "प्रथम दृष्टया निजी उद्यमों का अपना हित साधने के लिए सरकारी अधिकारियों के साथ गहरी सांठगांठ होना प्रतीत होता है। जांच एजेंसी को दो माह के भीतर 16 दिसंबर तक अपनी रिपोर्ट सौंपने के लिए कहा गया है। सीबीआई ने 31 जुलाई को अदालत को बताया कि 2जी स्पेक्ट्रम आवंटन घोटाले में राडिया की कुछ पत्रकारों सहित कई लोगों के साथ हुई बातचीत में आपराधिक तत्व मौजूद हैं। टेप की जांच करने वाली छह सदस्यीय समिति में पांच सीबीआई और आयकर विभाग के अधिकारी शामिल थे। इस टीम के गठन का आदेश शीर्ष अदालत ने 21 फरवरी 2013 को दिया था। शीर्ष अदालत ने 29 अगस्त को छह सदस्यीय समिति की रिपोर्ट की सुनवाई बंद कमरे में की थी।

NEW DELHI: The Supreme Court on Thursday ordered CBI to probe six instances of "prima facie criminality" which figure in the so-called Niira Radia tapes and report back to it in two months. This development could potentially portend more trouble for Corporate India as Radia's lobbying firm had some of India's biggest business groups, including the Tatas and RIL, as her clients.


A two-judge bench, comprising Justices GS Singhvi and V Gopala Gowda, directed the investigative agency to probe conversations that appear to refer to criminal acts. The judges did not spell out details in open court.


The court, instead, cryptically referred to these as issues 1, 2, 4, 5, 6, 7 and 14. These are part of a secret report put together by CBI, which has been submitted to the court. The court had earlier asked CBI to transcribe all 8,000 conversations, which had been recorded by government agencies, and get back to it.


In a short order delivered in open court, Justice Singhvi observed: "The conversations were prima facie indicative of deep-rooted malaise of connivance with government officials... suggesting interested persons used corrupt means to get favours from government officials."


Besides these six episodes referred to CBI, the court also referred some instances of alleged corruption in the judiciary and quasi-judicial tribunals to Chief Justice P Sathasivam for orders.


CBI is yet to transcribe all the tapes. The probe ordered on Thursday was based on the tapes that have been transcribed so far.

While transcribing some of these tapes, CBI had identified several conversations which prima facie appeared to refer to criminal acts. It had sought the apex court's permission to refer some of these to state police authorities for investigation.


But the top court only referred six issues to the agency, and did not elucidate on what these were. Neither did it direct CBI to register FIRs.


At the last hearing, Justice Singhvi had asked CBI to lodge FIRs under the Prevention of Corruption Act.


In its order on Thursday, however, the court stopped short of directing CBI to formally register FIRs, instead asking it to investigate these instances of prima facie criminality.


Some of these impinged on national security, Justice Singhvi had said at the last hearing.


The top court has been cagey about revealing details for fear of causing damage to the reputation of those involved.


CBI will now register what are called PEs (preliminary enquiries) and try to uncover proof of criminality, before returning with its report to the court for further directions.


In late 2010, many conversations between Radia and various industrialists, politicians and journalists were leaked by unknown persons. But the instances of alleged criminality are from conversations which were not leaked in 2010. Radia's phones were tapped by the income-tax department in 2008-09. Justice Singhvi retires on December 11, 2013. So CBI will either report back to some other bench or seek a further extension.

In the tape transcribed, one person is allegedly heard telling Radia that a sum of Rs 9 crore changed hands for a favourable judgement from a superior court judge who has since retired. The court also referred another issue, involving allotment of an iron ore mine to a company that did not have any steel plant, to the chief vigilance officer of the mines ministry for a probe.


Among other issues which could come under CBI's scanner include claims that former director-general of hydrocarbons VK Sibal was appointed at the behest of a particular company, and alleged I-T concessions to the PR firms owned by Radia referred by CBI as "I-T accommodation" issues.


Activist lawyer Prashant Bhushan, who has been demanding that the Radia tapes be made public except those that contain purely private conversations, said Sibal's appointment would be one issue under CBI's scanner.


The court also directed CBI to continue scrutiny of the remaining tapes. At the last hearing, the top court had given CBI three months to complete scrutiny of all taped conversations.

Radia tapes controversy

The Radia tapes controversy relates to the telephonic conversations between Nira Radia, a political lobbyist[1] and an acquaintance of the (then) Indian telecom minister A. Raja, and with senior journalists, politicians, and corporate houses,[2] taped by the Indian Income Tax Department in 2008–09. The tapes led to accusations of misconduct by many of these people. Nira Radia used to run a public relations firm named Vaishnavi Communications,[3][4] whose clients include the Tata Teleservices[5] and Mukesh Ambani's Reliance Industries.[6]

The Radia Tapes[edit]

After getting authorisation from the Home Ministry, the Indian Income Tax department[7] tapped Radia's phone lines for 300 days[8] in 2008–2009 as part of their investigations into possible money laundering, restricted financial practices, and tax evasion.

In November 2010, OPEN magazine[9] carried a story which reported transcripts of some of the telephone conversations of Nira Radia with senior journalists, politicians, and corporate houses, many of whom have denied the allegations.[10] The Central Bureau of Investigation has announced that they have 5,851 recordings of phone conversations by Radia, some of which outline Radia's attempts to broker deals in relation to the 2G spectrum sale.[11] The tapes appear to demonstrate how Radia attempted to use some media persons to influence the decision to appoint A. Raja as telecom minister.[12]

In the recorded conversations between Nira Radia and prominent figures, referred to as the Radia Tapes, several prominent figures are heard in conversation with Radia:[13][14]

According to the transcripts of the tapes, Radia lobbied against the reappointment of Dayanidhi Maran to the post of Union IT and Communications minister.

In a later conversation at 1047 IST, Barkha says that it (conveying the message to Congress) was 'not a problem' and that she would talk to Ghulam (Nabi Azad).[19]

  • Radia, in a later conversation with Ranjan Bhattacharya, who also appears to be acting as a conduit to the Congress,[1] mentions the above conversation, where she says, 'I made Barkha call up Congress, and get a statement from Congress whether the Prime Minister has actually said that he doesn't want Baalu, which she carried that he had never said it'. She also mentions to Bhattacharya, that 'your friend Sunil Mittal, has been lobbying against Raja (for Maran).'[20]

Media blackout and reactions in social media[edit]

The news gained prominence following sustained pressure on social networking sites Twitter[21][22] and Facebook[23] against an attempted blackout orchestrated by many prominent Indian TV channels and newspapers.[16][24] #barkhagate was a trending number one topic on Twitter in India for more than a week, since the break-out of the news.[25] According to the Washington Post, "Twitter has played an important role in launching what has become an international conversation on the issue, with the Indian diaspora weighing in".[26]

Initially, only a handful of the mainstream newspapers in India, like The Deccan Herald,[27] Indian Express[2] had openly written about the tapes. Some newspapers like HT MediaMint (the business newspaper also owned by HT media)[28] and NDTV said "the authenticity of these transcripts cannot be ascertained".[25][29] CNN-IBN's Sagarika Ghose discussed with a panel of experts, if the corporate lobbying is undermining democracy, on the 'Face the Nation' programme on the channel.[30] The Radia tapes is seen to have also made a dent in the image of the media in the country.[1][16][24][31][32][33][34] "The complete blackout of the Nira Radia tapes by the entire broadcast media and most of the major English newspapers paints a truer picture of corruption in the country," wrote G Sampath, the deputy editor of the Daily News and Analysis (DNA) newspaper.[16][35] After it became an international news, more and more media houses covered the story. The Deccan Chronicle commented, "The 'Radia tapes' may have torn the veil off the nexus between information hungry journalists, lobbyists and industrialists, and opened everyone's eyes to what has long been suspected — the ability of a small but powerful group to use their connections to influence policy."[36] The largest circulated english newspaper in India and the world, The Times of India finally opened up on 25 November 2010, commenting "The people are showing who the boss is. The weapon in their hands is the internet, ... has seen frantic activism against "power brokering" by journalists in collusion with corporate groups and top government politicians..."[37]

Protests and developments[edit]

Barkha Dutt, Vir Sanghvi, and others have refuted the allegations.[10][38][39] Open Magazine maintained that the conversations were carried as they appeared in the recordings.[40] Dutt defended her reputation through her Twitter account. "Struck by the bizarre irony of being accused of favouring a man i have never met (raja) and have always attacked in print and on TV. Gnite!," she said via one of her tweets on Twitter.[26]

New Delhi Television Limited posted a strong rebuttal on its website terming the insinuation that Barkha lobbied for A Raja as "unsubstantiated, baseless and defamatory" and threatened action against Open Magazine.[7][29][41]

Hindustan Times cited Sanghvi's clarifications on his website, and stated that the authenticity of these transcripts cannot be ascertained.[42] Vinod Mehta wrote opposition leader Arun Jaitley said Barkha Dutt pleaded to him not to mention about the conversation in the parliament while attacking the government on the 2G Scam.[43]

On 26 November 2010, Barkha Dutt released a detailed statement, addressing questions raised by the tapes, which she claims were edited.[44]

On 27 November 2010, Vir Sanghvi released a detailed statement, clarifying his role.[45]

Nira Radia has served a legal notice on The Pioneer, on the report titled "Tapped and Trapped" published by the newspaper. The notice asserted that The Pioneer's report regarding corruption and manipulation in the allotment of 2G spectrum to telecom operators, in so far as it referred to Radia's connections with Telecom Minister A Raja, are "absolutely false, baseless and malicious and constitute gross defamation".[46]

The original tapes are now annexures in a Supreme Court petition seeking Raja's prosecution. The opposition parties in India have demanded a Joint Parliamentary Committee (JPC) probe into the 2G spectrum scam, which could also to be extended to include a probe into the Radia tapes to ascertain the media's role in the controversy.[12] The Government is also accused of selectively releasing merely 10 hours of the 2000 hours recorded of the Radia tapes.[47]

The CBI in its affidavit in the Supreme Court in the 2G spectrum allocation case, on 22 November 2010, had stated that Radia will be approached for investigation at an appropriate time.[5] and that the probe would be completed latest by March 2011.[48] On 24 November 2010, Nira Radia was questioned by the Enforcement Directorate (ED) officials[49][50] and recorded her statements in relation to the 2G scam probe.[51]

On 1 August 2013 Supreme court asked whether the Income Tax department had informed the authorities which had directed the tapping of former corporate lobbyist Niira Radia's telephone about the sensitive and serious nature of the conversations.The Supreme court also asked whether the Income Tax department had informed the Central Bureau of Investigation (CBI) about the criminality of certain matters that surfaced from the conversations.[52]Chief Minister Madhu Koda asking for money from Tata Steel to issue a licence; lobbyist Niira Radia pulling strings with DMK politicians to help Tata Motors secure a contract; ex-telecom regulator Pradeep Baijal getting a plum post-retirement job; Reliance Industries' cosy relationship with the regulator; Reliance Communications of the Anil Dhirubhai Ambani Group fudging records – these allegations are among the 16 "issues" the CBI has red-flagged to the Supreme Court as evidence of alleged "criminality or irregularity" in intercepted phone conversations of lobbyist Niira Radia.This list, which re-opens the Radia controversy, was turned over to the apex court after it pushed the CBI into listening to all the 5,800 conversations tapped by the Income-Tax department rather than only those related to the 2G case as it did earlier. It prompted the judges to remark earlier this week that there are middlemen in "every nook and corner" of the government.The CBI has indicated that Radia herself is directly involved in only one of these cases which is listed as item number 1. It wants to probe four more and refer the others to state governments, CVOs of ministries and one to SEBI. It claims that intercepts also indicate a payoff to a former judge and a five-star swimming pool membership for a top law officer of the government but calls these "hearsay", and wants the Supreme Court to issue further directions.

Summary of CBI Report[edit]

The key issues based on intercepted conversations, as reportedly summarised by the CBI:

  1. Bus contract with Tamil Nadu: Ravi Kant, a top functionary of Tata Motors, was in touch with Radia for her to use her proximity with politicians in the DMK to secure the contract. Other conversations indicate tough competition between Tata Motors and Ashok Leyland and that complaints were sent to the state government on allegations of irregularities in orders. The CBI says it would be proper to refer this matter to the DGP of Tamil Nadu.
  2. Pradeep Baijal: Former chief of TRAI Baijal joined Noesis, a Niira Radia lobbying company. Phonetaps reveal he was then appointed Chairman of the Pipeline Advisory Committee of the Petroleum and Natural Gas Regulatory Board by the Government. Radia lobbied for RIL suggesting that this could be a case of ``some conflict of interest. The CBI wants to do a "thorough" inquiry.
  3. Madhu Koda: Rs 1.50 billion was allegedly demanded by Koda, then Jharkhand Chief Minister, for granting iron ore mine licence to the Tatas at Ankua. Tata Steel refused to pay and tried to get the licence through the Governor (Syed Sibte Razi) when the state was under President's rule. However since the licence was put on hold, the agency has asked for the matter to be referred to the Jharkhand DGP.
  4. Corruption and malpractice in judiciary/tribunals: The tapes reportedly contain allegations against some members of the judiciary and tribunals. One intercept is about a member of Telecom Disputes Settlement and Appellate Tribunal apparently ruling in favour of a corporate. There are conversations concerning a real estate issue in which a "favourable judgement was given by a High Court judge after allegedly receiving a Rs 9-crore payoff. Another conversation is understood to be about fixing a complimentary membership to a five-star swimming pool for a top law officer of the Government. The agency names the judge and the officer but these names are withheld in this report because the CBI says these allegations could be categorised as ``hearsay and the Supreme Court may like to pass suitable orders as deemed fit.
  5. Anil Ambani's Sasan Ultra Mega Power Project: Company was allegedly allowed to use excess coal from the mines for other projects of the company and this was challenged by rivals. Calling for a deeper CBI probe also into the role of Coal Ministry officials, the agency has noted that the CAG has also questioned this allotment and had said it caused substantial loss to the Government exchequer.
  6. RIL-regulator link: Former DG (Hydrocarbons) V K Sibal faced a CVC inquiry into the ownership of a flat in Mumbai as well as into favours extended to him by Reliance Industries Limited. In 2009, the CBI registered two PEs (preliminary inquiries) and one RC (regular case) against Sibal. The agency says the relevant telephone transcripts should be sent to their unit handling the Sibal cases.
  7. Fudging: "Fudged records and customer data were submitted by ADAG's Reliance Communications to the Telecom Regulatory Authority of India and the Bombay Stock Exchange which is alleged to have caused a loss to the Government exchequer to the tune of Rs 4.50 billion. This "appears to be a serious issue and requires a through CBI probe, the agency has reportedly told the court.
  8. Middlemen in aviation: CBI has named Ramesh Nambiar and Deepak Talwar as working actively in the aviation sector and reportedly wants to scrutinise seat-sharing arrangements by Air India and other Middle Eastern airlines. It has suggested that Talwar be put on the agency's UCM (undesirable contact men) list and the matter be referred to the Ministry of Civil Aviation's Chief Vigilance Officer.
  9. Iron ore mines to ADAG: One conversation has a reference to the allotment of an iron ore mine to ADAG without them having a steel plant but the CBI adds that since it is a "vague" conversation without specific details, it would be proper to refer it to the CVO in the Mines Ministry.
  10. Unitech-ADAG rivalry: Conversations indicating manipulation of markets and stocks but this could be "part of the corporate rivalry" between ADAG and Unitech. The matter should be referred to SEBI for suitable action, says the CBI.The CBI then lists three cases which it says have been dealt with "in detail" during investigations into the 2G spectrum allocation case. In three other cases it calls for no action saying there is neither specific evidence nor any allegation.
